Homey Rentals – Terms and Conditions

1. Acceptance of Terms

By creating an account, placing an order, or otherwise using the Homey Rentals website, mobile app, or related services (collectively, the “Services”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, do not access or use the Services.

2. Eligibility

  • Be at least 18 years old.
  • Have (or be listed on) a valid lodging reservation—hotel, Airbnb, Vrbo, or private residence—within our delivery area.
  • Provide accurate and complete information, including the name on the lodging reservation if different from your own.

3. Account Registration & Security

  • Safeguarding your account credentials.
  • Restricting access to your devices.
  • All activities that occur under your account.

We may suspend or terminate any account suspected of fraudulent or unauthorized activity.

4. Orders, Payment & Authorization Hold

  • Payment. Full payment—rental fees, purchase prices, taxes, and any service fees—is due at checkout.
  • Payment Methods. We accept major credit and debit cards via our third-party payment processor.
  • Free Delivery. Orders of $100 or more qualify for free delivery.
  • Authorization Hold. A pre-authorization hold equal to the full retail value of all rental items (plus packaging) is placed on your card. The hold is released when all items and packaging are returned in good condition. If the hold cannot be obtained before delivery, we will attempt to contact you; failure to secure the hold may result in order cancellation.

You must ensure the delivery location is accessible and someone is available to receive the order. Title and risk of loss transfer upon delivery.

6. Rental Period, Returns & Post-Stay Pickup

Unreturned Items. If an item (or provided packaging) is not returned, we will charge the full retail value.

  • Minor damage: cleaning/repair fee.
  • Beyond repair: full retail price.

7. Cancellations & Refunds

  • Cancel ≥ 72 hours before the scheduled delivery date → full refund minus any non-refundable service charges.
  • Cancel < 72 hours before delivery or after rental begins → no refund.
  • Purchased items (including sanitary, perishable, or personal-use goods) are non-refundable.
  • If Homey Rentals cancels your order (e.g., inventory error), you will receive a full refund.

8. Use of Rental Items & Customer Responsibilities

  • Use items responsibly and only for their intended purpose.
  • Follow all manufacturer instructions, safety guidelines, and local regulations.
  • Assume full responsibility for loss, theft, or damage while items are in your possession.
  • Provide accurate delivery information; Homey Rentals is not liable for failed deliveries due to incorrect or inaccessible addresses.

9. Marketplace Platform & Third-Party Providers

Homey Rentals is a marketplace that connects customers with independent third-party providers (“Providers”). Providers are not employees, agents, or partners of Homey Rentals. Homey does not manufacture, maintain, or warrant the items supplied by Providers and is not liable for their acts or omissions. Any dispute regarding item condition, safety, or availability is between you and the Provider, subject to the limitations set forth in these Terms.

10. Product Use Disclaimer & No Warranties

The Services and all rental or purchased items are provided “as is” and “as available.” Homey Rentals disclaims all express and implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free, or that any item will meet your specific expectations.

11. Limitation of Liability

To the fullest extent permitted by law:

  • Homey Rentals’ total liability for any claim arising out of or relating to these Terms or the Services shall not exceed the total amount you paid for the transaction giving rise to the claim.
  • Homey Rentals will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages (including lost profits, personal injury, or property damage) arising from or related to your use of the Services or any item.

12. Indemnification

You agree to defend, indemnify, and hold harmless Homey Rentals, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  1. Your use or misuse of any item or the Services;
  2. Your breach of these Terms or applicable laws; or
  3. Any injury, damage, or loss caused by your negligence or willful misconduct.

13. Intellectual Property

All content on the Homey Rentals platform—logos, text, graphics, photos, videos, software, and other materials—is owned by Homey Rentals or its licensors and protected by intellectual-property laws. You are granted a limited, non-exclusive, non-transferable license to use the platform for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works without our prior written consent.

User-Generated Content. By submitting reviews, photos, or other content, you grant Homey Rentals a worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute that content in connection with the Services. You represent that you have all rights necessary for such submissions.

14. Privacy & Data Handling

Your use of the Services is also governed by the Homey Rentals Privacy Policy, incorporated herein by reference. By using the Services, you consent to our collection, use, disclosure, and processing of personal information as described in that policy, including sharing necessary details with Providers and third-party service partners.

15. Dispute Resolution – Arbitration & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

  • Binding Arbitration. You and Homey Rentals agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved exclusively through final and binding arbitration, administered by the American Arbitration Association under its Consumer Arbitration Rules.
  • No Class Actions. You may bring claims only in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
  • Jury-Trial Waiver. If a dispute is found by a court not to be subject to arbitration, you and Homey Rentals waive any right to a jury trial.

Nothing herein prevents either party from seeking injunctive relief in a court of competent jurisdiction for misuse of intellectual property or other equitable relief.

16. Governing Law & Venue

These Terms and any dispute (unless submitted to arbitration) are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Subject to Section 15, you consent to exclusive jurisdiction and venue in the state and federal courts located in New York County, New York.

17. Force Majeure

Homey Rentals is not liable for any delay or failure in performance caused by events beyond its reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, governmental actions, power failures, or internet outages.

18. Modifications to Terms

We may update these Terms from time to time. Material changes will be posted on the Homey Rentals website and, where required by law, we will provide notice. Continued use of the Services after the effective date constitutes acceptance of the revised Terms.

19. Severability

If any provision of these Terms is held unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force.
